Terms of Service

1. Acceptance of Terms

By accessing and using Mafans.co.ke ("the Service," "we," "us," or "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms apply to all users of the Service, including visitors, registered users, and administrators. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Service Description

Mafans.co.ke is a web-based platform that provides:

  • Football match predictions and analysis
  • Odds comparison across multiple bookmakers
  • Match statistics, head-to-head data, and team information
  • Personalized content and recommendations
  • User accounts for saving favorites and preferences

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts and Responsibilities

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Age Requirement

You must be at least 18 years old to use this Service. By creating an account, you represent and warrant that you meet this age requirement.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Acceptable Use Policy

  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers, etc.) to access the Service without permission
  • Impersonate any person or entity or falsely state your affiliation with any person or entity
  • Upload or transmit any viruses, malware, or malicious code
  • Collect or store personal data about other users without permission
  • Use the Service to transmit spam, unsolicited messages, or promotional materials
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Use the Service in any manner that could damage, disable, or impair our systems

Violation of this Acceptable Use Policy may result in immediate termination of your account and legal action.

5. Intellectual Property Rights

5.1 Our Content

All content on the Service, including but not limited to text, graphics, logos, images, software, predictions, and analysis, is the property of Mafans.co.ke or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise use our content without our express written permission.

5.2 User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the Service.

6. Predictions and Betting Disclaimer

Our predictions are for informational purposes only. They are based on statistical analysis, historical data, and algorithmic models, but do not guarantee outcomes. Past performance does not guarantee future results.

We do not encourage or endorse gambling. If you choose to use our predictions for betting purposes, you do so at your own risk. Gambling can be addictive and may result in financial loss.

We are not responsible for any losses incurred as a result of using our predictions or services. You are solely responsible for any decisions you make based on our content.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAFANS.CO.KE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from the use or inability to use the Service
  • Errors, inaccuracies, or omissions in our content or predictions
  • Interruptions or cessation of the Service
  • Losses incurred from gambling or betting activities

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security or freedom from viruses or harmful components

We do not warrant that the Service will meet your requirements or be available at all times. We are not responsible for any delays, failures, or errors caused by third-party services or networks.

9. Account Termination

9.1 Termination by You

You may terminate your account at any time by deleting your account through your account settings or by contacting us at tech@mafans.co.ke.

9.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activities
  • Use the Service in a manner that harms us or other users
  • Provide false or misleading information
  • Fail to pay required fees (if applicable)

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive.

10. Third-Party Services

The Service may contain links to third-party websites, services, or content. We are not responsible for the content, privacy policies, or practices of third-party services. Your interactions with third parties are solely between you and the third party.

When you use OAuth providers (Google, Facebook) to sign in, you are also subject to their terms of service and privacy policies.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mafans.co.ke, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to the Service

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page with a new "Last updated" date
  • Sending an email notification to registered users (for significant changes)
  • Displaying a notice on our website

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kenya.

Before filing a formal legal claim, you agree to first contact us at tech@mafans.co.keto attempt to resolve the dispute informally.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mafans.co.ke regarding your use of the Service and supersede all prior agreements and understandings.
